Consent Orders are a way of formalising an agreement reached after separation without needing to attend Court for a hearing.
Where former partners are able to agree on matters such as property settlement or parenting arrangements, the terms of that agreement can be put into written orders and filed with the Court for approval. The Court then considers the documents and, if satisfied the orders are appropriate, makes them without either party needing to appear before a judge.
Once made, Consent Orders are legally binding and enforceable.
This process can provide certainty and finality while avoiding the time, cost and stress that can come with contested court proceedings. It also ensures that the agreement is properly documented, rather than relying on an informal arrangement that may later become uncertain or disputed.
Consent Orders are commonly used to finalise property settlements and parenting arrangements after separation.
At Alta Legal, we assist clients in preparing and lodging Consent Orders so that the agreement reached is accurately recorded and formalised in a way that provides lasting certainty.
